Information for the Defendant

A lawsuit has been filed against you. If you wish to contest the Plaintiff’s claim, you must appear at trial on the date listed on the Affidavit and Summons. If you fail to appear at trial, a judgment may be entered against you for the amount requested.

You may settle the claim before the trial date. If a settlement is reached before the trial date, the Plaintiff can request the claim be dismissed.

If you wish to file a counterclaim, you must file a Counter Affidavit (PDF). This form must be filed with the court at least 15 calendar days prior to the trial date. The following fees apply:

  • $50.00 for claims $2,000 or less
  • $70.00 for claims of $2,001 to $7,500
  • $120 for claims of $7,501 to $11,000

On the day of your trial, you must have 3 copies of all evidence you wish to submit. One copy is for you, second is for the Judge and third is for the Defendant. Please make sure all copies are organized and numbered exactly the same. Failure to provide 3 copies could result in your trial being continued.
